この利用規約（以下「本規約」という。）は、独立行政法人国際交流基金日本語国際センター（以下、「当センター」という。）の運営する「みんなのCan-doサイト」（以下、「当サイト」という。）を利用する際の、当サイトの利用者（以下、「ユーザー」という。）および当サイトの会員登録をしたユーザー（以下「登録ユーザー」という。）と当センターとの間の一切の関係に適用されます。当サイトを利用されるみなさまは、当サイトにアクセスしてこれを利用した場合は、本規約に同意したものとみなします。 当サイトでユーザー登録をした方は、同じメールアドレスとパスワードで「みんなの教材サイト」にもログインできるようになります。どちらかのサイトを退会すると、両方のサイトにログインできなくなりますのでご注意ください。

1. 本規約の適用範囲等

  1. 本規約は、当サイトを利用するすべてのユーザーに適用されます。
  2. 本規約は、当センターが別途定める「サイトポリシー」の一部を構成します。 また、当センターが別途定める「プライバシーポリシー」および 「著作権ポリシー」も本規約の一部となります。本規約に同意することで、 当該「サイトポリシー」、 「プライバシーポリシー」および 「著作権ポリシー」の全てに同意することになります。

2. 登録ユーザー

  1. 当サイトでマイページ機能をご利用いただくには、ユーザー登録が必要です。なお、各国の法律に照らして、ユーザーの年齢等から個人情報の収集に支障があると当センターにおいて判断した場合、収集した個人情報の一部若しくは全部を削除し、またはユーザー登録をお断りする場合があります。
    16歳未満の方は保護責任者の同意を得た上で利用してください。
  2. 登録料および利用料は無料です。
  3. 登録ユーザーは、登録内容に変更があった場合には、速やかに所定の変更手続きを行うものとします。
  4. 登録ユーザーは、退会する場合、所定の方法で当センターに届け出るものとします。

3. メールアドレス、パスワードの管理について

  1. 登録ユーザーは、当サイトのID、パスワードを厳重に管理するものとし、第三者への譲渡、貸与等は行わないこととします。
  2. 登録ユーザーによるID、パスワードの漏洩、不正使用による損害が生じた場合の責任は登録ユーザーが負うものとし、当センターは一切の責任を負いません。

4. 禁止事項

  1. ユーザーは、当サイトの利用において、以下の行為を行わないものとします。
    ①著作権、商標権、その他知的財産権、肖像権・プライバシー権、名誉等の第三者または当センターの権利を侵害する行為、②第三者または当センターを誹謗中傷する行為、③有害なコンピュータプログラムなどを送信または書き込む行為、④犯罪行為、⑤法令、公序良俗に反する行為、またはそのおそれのある行為、⑥当サイトを利用した営利を目的とした行為、⑦政治・選挙活動に関わる行為、⑧宗教布教、特定の主義、主張、政策の普及を直接の目的とする行為、⑨虚偽の情報を登録する行為、⑩その他、当サイトの運営を妨げる行為、当センターの信頼を毀損する行為または上記①ないし⑨に準じる行為で当センターが適切でないと判断した行為
  2. ユーザーが前項に違反して当センターに損害を与えた場合、当該ユーザーは当センターに対して与えた一切の損害を賠償するものとします。

5. 利用の停止・登録の抹消等

当センターは、登録ユーザーが以下のいずれかの項目に該当すると判断した場合、当該ユーザーに事前に通知することなく、当該ユーザーの当サイトにおけるマイページの利用を一時停止（マイページの利用によって当サイト上で当該ユーザーが行った書き込みその他の記載の削除を含む。）、または当サイトにおけるユーザー登録を抹消することができるものとします。

  1. 当サイトを不正に利用した場合
  2. 本規約のいずれかに違反した場合
  3. その他当センターが不適切と判断する行為を行った場合

6. 免責

  1. 当センターは、当サイトのコンテンツの正確性の確保に努めてはおりますが、提供している情報に関していかなる保証もするものではありません。当サイトの利用によって何らかの損害が発生した場合でも、当センターは一切の責任を負いません。自己の責任においてご利用下さい。
  2. 当サイトで提供するJF Can-doは、日本語の使用場面に即し、かつCEFRの共通参照レベルに対応するよう当センターが自らの判断において作成したコミュニケーション言語活動（communicative language activities）の例です。当センターはCEFR Can-doの構造とレベルの特徴の分析に基づいてJF Can-doを作成し、検証を行ってはおりますが、JF Can-doの内容の妥当性や、共通参照レベルとの合致を保証するものではありません。また、JF Can-doにおいて日本語能力がすべての側面から正確に記述されていることを保証するものではありません。
  3. 当サイトで提供する「Can-do」を利用してコースデザインやカリキュラム作成、試験作成や検定試験を行った場合、その正確性や有効性の責任はそれぞれの実施主体にあり、当サイトで提供する「Can-do」の著作者である当センターおよび欧州評議会は一切の責任を負いません。
  4. 当サイトのセキュリティには細心の注意を払っておりますが、コンテンツの誤り、第三者による人為的改ざん等の不可抗力によるコンテンツの誤り等が発生する可能性を全て排除することを保証するものではなく、当サイトの利用、あるいは当サイトを利用できなかったことによって何らかの損害が発生した場合でも、当センターは一切の責任を負いません。
  5. 当サイトのコンテンツ（「Can-do」）およびURLは予告なしに変更、追加、または削除されることがあります。また、システムの障害やメンテナンスなどのため、当サイトのサービスの全部もしくは一部を中止することがあります。このようなコンテンツ等の変更およびサービスの中止によってユーザーに何らかの損害が発生した場合でも、当センターは一切の責任を負いません。
  6. 当サイトには、ユーザーの便宜のため、当センターの責任の及ばない第三者が開発したコンテンツ、リンク、およびその他の情報ならびに当センターが独自に行ったそれらの翻訳が含まれます。
  7. 当サイトを利用するにあたって、ユーザー間、またはユーザーと第三者との間で何らかの紛争が発生した場合は、当事者間で解決してください。当センターは、当該紛争の解決に関して何ら関与しないものとします。
  8. 当サイトを利用するためのあらゆる機器、通信手段、ソフトウェアなどはユーザーが自己の責任と費用で適切に設置および操作するものとし、本サイトの利用にあたって通信費、パケット通信料等が生じた場合は、すべてユーザーが負担するものとします。

7. 本規約の変更

当センターは、本規約を随時変更することができるものとします。本規約の変更の内容については当サイトに表示した時点で、当サイトを利用されるみなさますべてが、これを承諾したものとみなします。

8. 準拠法および合意管轄

本規約の準拠法は日本法とし、本規約に関して生じる一切の紛争については、さいたま地方裁判所またはさいたま簡易裁判所を第一審の専属的合意管轄裁判所とします。

付則

この規約は2023年3月27日制定、2023年3月27日より実施します。

These terms of service (“these Terms” hereafter) apply to any relationship between users (“Users” hereafter) or registered users (“Registered Users” hereafter) of the ‘Minna no Can-do’ website (“the Site” hereafter) run by the Japan Foundation Japanese-Language Institute, Urawa (“the Institute” hereafter) and the Institute. By accessing and using the Site, users of the Site are assumed to agree to these Terms.
Registered Users will be able to log in to the ‘Minna no kyozai’ website with the same e-mail address and password. Please note that if you retire from membership of either site, you will no longer be able to log in to both sites.

Article 1 The scope of application of these Terms etc.

  1. These Terms apply to all users of the Site.
  2. These Terms form part of the ‘Site policy’ that the Institute separately specify. ‘Privacy policy’ and ‘Copyright’ also form a part of these Terms. By agreeing to these Terms, you agree to all of the ‘Site policy’, ‘Privacy policy’ and ‘copyright’.

Article 2 Registered users

  1. To use the My Page function on the Site, user registration is required. In addition, in light of the laws of each country, if the Institute determines from, for example, the user’s age that there is a problem with the collection of personal information, some or all of the collected information may be deleted or registration may be refused.
    Those under the age of 16 can only use the Site with the consent of their parent, legal guardian, or teacher.
  2. Registration and usage are free.
  3. Registered Users will promptly make changes using the designated procedures when there is a change to their registered information.
  4. Registered Users shall notify the Institute in the designated manner when they withdraw from membership.

Article 3 About management of e-mail address and password

  1. Registered Users shall carefully manage the e-mail address and password for the Site, and shall not, for example, assign or lend it to third parties.
  2. Registered Users shall assume responsibility in the event that damage occurs due to e-mail address or password leakage, misappropriation, etc. by the Registered User. The Institute shall not assume any responsibility in this case.

Article 4 Prohibitions

  1. 1. Users shall not engage in the following acts when using the site.
    (1) Behavior that infringes copyrights, trademark, other intellectual property rights, assets, portrait rights or privacy
    (2) Falsely accuse third-parties or the Institute
    (3) Send or write harmful computer programs
    (4) Criminal acts
    (5) Offend public order and morals
    (6) Use the Site for commercial purposes
    (7) Acts related to politics and election activities
    (8) Acts with the direct purpose of propagandizing religions or disseminating a particular doctrine, idea or policy
    (9) Acts of registering false information
    (10) In addition to the above, acts that prejudice the operation of the Site, acts that damage the trust of the Institute, and acts that apply to (1) to (9) above that the Institute deems inappropriate.
  2. 2. When a User damages the Institute by violating the above prohibitions, the Institution has the right to ask the User for compensation.

Article 5 Stopping usage and deleting registration

If any of the following items apply to a Registered User, the Institute will suspend his/her usage (including the deletion of anything written or posted on the Site), or delete his/her registration of the Site without notifying him/her in advance.

  1. If the Site is used illegally
  2. If any of these Terms are violated
  3. In addition to the above, if an act takes place that the Institute deems to be inappropriate

Article 6 Disclaimer

  1. The Institute makes every effort to ensure accuracy of site content, yet does not guarantee the information provided on the Site. The Institute bears no responsibility for any damage caused through use of the Site; Users bear responsibility for any use of the Site.
  2. The JF Can-dos offered on the Site are examples of communicative language activities newly created using our own judgement, in order to conform to each common reference level of the CEFR and in line with situations in which Japanese is used, based on analysis of the structure and level features of CEFR Can-dos carried out at the Institute. The Institute created JF Can-dos and carried out verification on them, but the validity of the Can-dos or their correspondence to the common reference levels cannot be guaranteed. In addition, it cannot be guaranteed that an accurate description including every aspect of Japanese language ability has been given in the JF Can-dos.
  3. In the event that the Can-dos offered on the Site are used for course design and to create curriculum, create tests and conduct official exams, the responsibility for their accuracy and effectiveness lies with each implementing body, and the authors of the Can-dos offered on the Site, the Council of Europe and the Institute, do not assume any responsibility.
  4. The utmost care is given to security on the Site. However, this does not guarantee that the possibility of mistaken contents resulting from uncontrollable factors, such as falsification by a third party, is completely eliminated. The Institute does not bear responsibility for any damage to persons resulting from the use of the Site or not being able to use the Site.
  5. Site content (Can-do) and URL may be changed, added or deleted without advance notice. In addition, all or part of site services may be stopped due to system error or maintenance. The Institute bears no responsibility for any damage caused by such changes in content and service stoppage.
  6. For the convenience of Users, the Site offers content provided by third parties, links and other information, for which the Institute cannot bear responsibility, as well as translation by the Institute of these contents.
  7. In the event of any trouble between Users or between Users and a third party, it is to be resolved by the concerned parties.
  8. Users shall set up and operate all devices, communication tools, softwares, etc., to connect and use the Site and the service properly at their own responsibility and expense. Users shall acknowledge and agree that packet communication fees, etc., may accrue to connect and use the Site. In addition, Users shall be responsible for paying all of their packet communication fees, etc.

Article 7 Change of the Terms

The Institute may amend these Terms without any prior notice. People who access and use the Site are deemed to agree with updated version of these Terms.

Article 8 Legal Standards and Court Jurisdiction

These Terms shall be subject to the laws of Japan. Any dispute between Users and the Institute relating to these Terms shall be submitted to the Saitama Summary Court or the Saitama District Court.

Appendix

The Terms were revised on March 27 2023, and will be implemented from March 27 2023.
